Rules & Regulations
Rules, Regulations, Covenants and Architectural Guidelines for Uwharrie Point are available from the Uwharrie Point Community Association Office (hereinafter “UPCA”). They are so detailed, as most are taken from the recorded and corporate Governing Documents, that many property owners are not aware of those rules and restrictions which apply to them. The purpose of this booklet is to promulgate those rules and regulations most frequently encountered. It also contains some additional regulations approved by the UPCA Board of Directors, and alerts property owners and other persons subject thereto to the use of possible fines for violations. For the exact legal terms and conditions that may apply you should refer directly to the Governing Documents.
The Uwharrie Point Community Association Rules and Regulations are subject and subordinate to the underlying Governing Documents and to all applicable federal, state, county and city statutes, ordinances, rules and regulations having jurisdiction over the Uwharrie Point Development. In the event of any conflict between the Rules and Regulations, the Governing Documents and such laws, the Governing Documents and/or such laws shall be controlling.

1. Traffic Regulations
GENERAL: All State of North Carolina Motor Vehicles Laws pertain while driving in Uwharrie Point. The following rules are established to carry out the general purpose of these Rules and Regulations. UPCA bears no and accepts no liability for injury to any persons or property arising out of the breach of these rules and or the enforcement or non-enforcement thereof.
All vehicles in the community shall be operated in a safe and prudent manner so as not to endanger any person or property.
The UPCA Security and the Community Association Manager shall enforce all traffic regulations in the community, including the 25 m.p.h. speed limit (unless otherwise posted); observance of all traffic signs (i.e. stop signs, yield signs, caution signs, etc.), and a prohibition on improper parking (i.e. handicapped spaces without permit, road shoulders, blocking driveways, blocking mailboxes, blocking emergency access or fire lanes, etc.), reckless driving, and careless driving. Enforcement of this policy may include the use of radar devices, cameras, notices, etc.
A.Speed Limit
The speed limit in Uwharrie Point is 25 m.p.h. (except where posted otherwise) and will be enforced by UPCA Security, which may include the use of radar devices.
B. Parking
a.Parking is not permitted on the road shoulders within the Association owned right-of-way, in designated handicapped spaces without permit, blocking driveways, blocking mailboxes, or blocking emergency access or fire lanes.
b.Temporary parking on streets is permitted for special events or guests. Prolonged, overnight parking on the streets is prohibited.
c.Vehicles parked temporarily in the street must park on only one side of the street with the flow of traffic in order for access to remain open for emergency vehicles and regular traffic.
d.All construction vehicles should park on the building site under development if possible. If there is insufficient space on the building site, the parking of construction vehicles may be permitted on the construction side of the road pavement during work hours only.
e.Large trucks are allowed to stop on the roads immediately adjacent to the construction site to unload if there is not sufficient room on the site.
f. Residents must advise the Gatehouse as to any event at their home where there may be overflow parking in the street. The Association can arrange to have additional guards to direct parking or rope off no-parking areas.
g.Disabled vehicles may be left on the road, but not on the road shoulder, when the driver arranges for the vehicle to be towed, but for no longer than 24 hours.
h.No boats, trailers, jet skis, campers, motor homes, commercial vehicles, lawn equipment, ATVs, etc. shall be parked on any lot, on the common areas, or on any right-of-way roads or shoulders within the community, except inside an enclosed garage or specified storage area approved by the ARB.
i.Delivery and maintenance vehicles are permitted to park on the roadway during brief deliveries and servicing of residences.
C. Pedestrians
a. Extreme caution should be exercised to avoid endangering bicyclists and pedestrians and when passing slow moving vehicles such as golf carts, landscape service equipment, golf course maintenance equipment, etc. Passing on the road shoulders is prohibited.
b. Bicyclists must ride single file with the traffic in accordance with North Carolina law. Bicycles may not be ridden after dark unless equipped with lights and reflectors.
c. Walkers and joggers are encouraged to use the walking trails within the community. If using the streets, they should travel against the flow of traffic.
D. Reckless or Careless Driving
Any form of reckless or careless driving within the community will be reported to the Montgomery County Sheriff's Department. Damage to personal or real property caused by reckless or careless driving, excessive speeding, endangering or threatening the lives of others could result in charges.
E. Policy for Driving on Community Streets
It shall be required of all persons driving on Uwharrie Point Community Association property to meet the North Carolina Department of Motor Vehicles standards for operating a motor vehicle which includes but is not limited to, be of legal driving age, possess a valid drivers license, and maintain sufficient liability insurance coverage.
The Uwharrie Point security officers and the Community Association Manager are hereby authorized to address all violations of this policy.
F. Use of Licensed and Non-licensed* Motorized Vehicles within the Community
Operators of any licensed or non-licensed motorized vehicle within the community must be at least 16 years of age, possess a valid driver's license, have liability coverage for the operation of such vehicles and observe all traffic regulations. Motorized vehicles are prohibited from being driven on the walking trails and cart paths. The Association is not responsible for accidents or injuries resulting from the use of motorized vehicles within the community. All motorized vehicles used within the community must be registered with the Community Association and display a Uwharrie Point Vehicle decal. Decals may be obtained at the UPCA Office by completing a vehicle registration form. Proof of insurance is required to obtain a decal for non-licensed vehicles.
*Non-licensed motorized vehicles include but are not limited to private golf carts, scooters, mopeds, dirt bikes, go-carts, all-terrain vehicles, etc.
G. Vehicle Decals and Gate Access Cards
Only employees in the UPCA Office and those designated by UPCA are authorized to issue vehicle decals and gate cards. A vehicle decal form must be completed listing all vehicles before a decal is issued.
UPCA staff and those designated by UPCA will verify that the person is a member of UPCA or the Old North State Club (ONSC) before issuing a vehicle decal and/or gate access card according to the requirements below.
Vehicle Decals:
A. Only members of UPCA and ONSC will be issued vehicle decals. This will allow members to enter the community at any time without being signed-in by security.
B. Members should have a vehicle decal for each of their vehicles that are driven within Uwharrie Point.
C. If a UPCA member sells their property or an ONSC member cancels their membership, they will be required to remove their vehicle decal.
D. Employees, guests, contractors, vendors, etc. shall not have a vehicle decal and will need to sign in with security each time they enter the community.
Gate Access Cards:
A. Only members of UPCA will be issued gate access cards. This will allow members to enter the community in the event a security guard is away from the guardhouse, or to access the other gated areas within the community.
B. UPCA members’ gate access cards will be valid for use at the Main entrance gate, Western Spur gate, Waste Disposal Facility and Marina.
C. If a UPCA member sells their property, therefore causing them to forfeit their membership with UPCA, they will be required to return their gate cards. If a gate card is not returned, UPCA will delete the number from the gate access system.
D. UPCA members should not allow anyone to use their gate access cards (i.e. housekeepers, landscapers, etc.)
E. UPCA members will initially be issued 2 gate access cards at no charge. Additional cards may be issued at a cost of $5.00 each.
F. Employees of UPCA, ONSC facility maintenance, ONSC golf course maintenance, and the community landscaping company under contract will be issued gate access cards in order to perform their daily job responsibilities. The gate cards are to be used during working hours only and should be kept in a secure location at the job site when not in use.
2. Security
A. All homeowners should have a current Homeowners Information Sheet on file with security that lists those people who frequently visit and are authorized by the owner to enter. Contact the UPCA office or security if you need to update your information.
B. Notify security prior to the arrival of guests, deliveries or contractors. If security has not been provided the names and time of arrival, guests, deliveries or contractors will not be allowed to enter the community and will be turned away.
C. Homeowners should notify security if they plan to be away from home for an extended amount of time and provide them with emergency contact numbers while away.
3. Community Access
A. Uwharrie Point has three gates in which to gain authorized access. The Main Gate is for property owners and guests. The Construction Gate is for construction traffic, vendors, and employees. The Western Spur Gate or side gate is for maintenance employees, and owner access to the waste facility.
B. The Construction Gate will be locked from 6 pm—6 am daily and the side gate exiting towards Heron Bay will be locked from 8 pm—5 am daily. Everyone will need to enter through the main gate during those times. Gate cards will not function.
C. Only property owners with vehicle decals and/or gate access cards will be able to enter without signing in with security. ALL contractors, guests, clients, etc. will have to sign in each time they enter. If a contractor or guest is not on a property owner’s approved entry list, they will not be allowed to enter without notification from the property owner.
D. Furthermore, all departments within Uwharrie Point who are expecting guests, clients, or any visitor will need to notify the guardhouse at 461-4502 with the name of the visitor, date and time of appointment. If a visitor arrives at the guardhouse without notification of their arrival, security will not call the department to inquire whether the visitor is allowed to enter. The visitor will not be allowed to enter until security is notified by the homeowner.
The following visitors are authorized to enter without prior notification and will not need to be signed in:
A. Emergency Personnel: law enforcement, fire department, medical personnel, etc.
B. County Officials: Yadkin/Alcoa, Building Inspectors, Department of Taxation, etc.
C. Service Representatives: Handy Sanitary, Energy United, Randolph Telephone, Uwharrie Communications, etc.
The following visitors will be signed in by security and are authorized to enter without prior notification:
A. Prospects: The Sales Center will be notified that a prospect is coming in and prospect will be directed to the Sales Center.
B. Newspaper delivery personnel.
4. Homeowner Keys
The Guardhouse currently secures keys to many of the homes in Uwharrie Point that owners have left for housekeepers, maintenance, guests, etc. to have available when needed. The keys are in a locked area and are number coded instead of by names to provide security. Homeowners will need to complete a key authorization form authorizing Security to possess the keys to their home. A list of who is authorized to have access to the keys will need to be provided. In the event an owner needs someone to access their keys and they are not on the authorized list, Security will need to be notified with approval by the homeowner.
5. Residential Alarms
A. Homeowners who have a fire alarm, security alarm, etc. that is activated, the proper Montgomery County emergency services should be provided as the contact. The Uwharrie Point Guardhouse phone number should not be listed as a contact for your alarm system..
B. If the alarm is activated on your grinder pump at your Uwharrie Point home, you should immediately contact a plumbing contractor. Do not call Handy Sanitary or the Uwharrie Point Guardhouse.
6. Recreation Vehicles
The storage of boats, jet skis, trailers, etc. on individual properties is prohibited unless screened (in a manner approved by the ARB) from view from the street and all adjacent properties.
7. Signs
Security company signs, invisible fence signs, subcontractor signs, etc. are not allowed within the community. Only signs that meet the sign guidelines may be installed. Signs on lots with construction in process are limited to:
a. The lot owner
b. The Architect, if applicable
c. The general contractor’s name
d. A real estate company, if applicable
All signs come under the Standard Sign Policy for Uwharrie Point and must be constructed and maintained under those standards. Contact the UPCA office for more details.
8. Mailbox (also includes 911 posts)
The initial purchase of a new mailbox structure will be the responsibility of the homeowner. The owner will need to notify the Community Association to order a new mailbox. If a homeowner or contractor damages a mailbox, the owner/contractor will be responsible for the replacement costs.
Once the initial mailbox is purchased by the owner, it will be the responsibility of the Uwharrie Point Community Association to maintain and replace mailbox structures within the community.
Mailbox inspections will be conducted by UPCA on an on-going basis. Work will be performed once the appropriate maintenance is identified. This will include maintenance for individual mailboxes, mailbox posts, number plates, and nameplates. Maintenance will include removal of peeling or flaking paint; painting; removal of dirt, mildew, algae; straightening post if not plumb, (i.e. leaning or crooked); replacing mailboxes, posts, nameplates and number plates after the initial purchase.
Note: Replacement nameplates, number plates, posts, and mailboxes must match the existing standards set forth by UPCA and must be obtained through the Community Association Office.
9. Pet Resolution
All pets within Uwharrie Point should remain on the property of the owner at all times. Should a pet be off the property it must be accompanied by the owner and should be either on a leash or under the control of the owner. Pets are not allowed to freely roam onto others property or within the community.
Besides being a nuisance, uncollected dog waste is very unsightly and malodorous. In the event a pet does mistakenly use an inappropriate area such as streets, sidewalks, right-of-ways, golf course, or anyone else’s property, the owner should clean up after it.
Furthermore, pet owners should make every effort to ensure that their pet does not bark continuously or make loud noises that might be a nuisance to neighbors.
10. Property Owner Signs
The Uwharrie Point Community Association will be responsible for maintaining property owner identification signs on unimproved lots within the community effective June 30, 2005.
Sign inspections will be conducted on an on-going basis and maintenance such as cleaning or painting will be performed as needed.
The initial purchase of a new property owner sign or the replacement thereof will be the responsibility of the property owner. The owner will need to contact the Community Association Office to order a sign. If an owner or contractor damages a sign, the owner/contractor will be responsible for the replacement costs.
Note: Replacement property owner signs must match the existing standards set forth by UPCA and must be obtained through the Community Association Office.
11. Open House Sign Policy
“Open House” signs are permitted within Uwharrie Point as long as they comply with the following guidelines, as adopted by the Architectural Review Board.
Signs - 18” x 24” Green chloroplast sign
2 ½” to 3” white vinyl letters stating “Open House”
White vinyl directional arrow
Heavy-duty silver wire frame
Signs may be put up one hour prior to the scheduled open house time and must be removed within one hour after the advertised ending time. If an open house runs for more than one day, the signs must be removed each day.
Quantity and Location of signs: One (1) sign may be placed at the third tee box on the right side of the parkway. One (1) sign may be placed at the neighborhood entrance indicating that you turn left or right into the neighborhood where the open house is being held. One (1) sign may be placed at each intersection where a turn is required. One (1) sign may be placed in front of the open house. If the open house is south of Old North State Club Lane a second sign may be placed along the parkway indicating that they should continue into Southpoint.
12. 911 Address Policy
Address numbers will be placed on a 1” x 6” green panel similar in design to the name plate for mailboxes. The house number panel will be attached below the paper box on the mailbox and will have 4” reflective white numbers on each side of the panel.
All residences on the water are required to have 911 addressing visible from the lake. The numbers must be 4” reflective numbers and may be placed on the pier. If there is no pier, if residents choose not to place the numbers on the pier, or if the pier is shared by multiple users, the 911 address will be placed on the 1” x 6” green panel mounted on a white post. 4” reflective white numbers will be used on the green panel.
All residents who choose not to install a mailbox will be required to install the 911 address at the street. A green panel, with 4” reflective white numbers, will hang from the arm of a white post. The 911 address numbers will be required on each side of the panel.
House numbers will not be allowed on a residence unless they are on the approved green panel with the approved 4” numbers. The green panel must be affixed to the residence so that it is visible from the street. If the house is greater than 50’ from the street the resident will be required to post the 911 address at the street by one of the two approved methods listed above.
Uwharrie Point Community Association (UPCA) will be responsible for providing all posts, panels, mailboxes, and numbers. UPCA will also provide for installation once payment is received from the homeowner.
13. Inclement Weather Emergency Procedures
During times of adverse weather conditions the basement of the clubhouse will be utilized as a shelter. Upon issuance of a “warning” by the National Weather Service, the security guard on duty will go to the clubhouse and unlock the basement area so that any person wishing to seek shelter may do so. Because of the risk of power failure during times of severe storms, the main gate and construction gate will be kept open. The security guard on duty will have the option of staying in the guard house or the basement of the clubhouse, based on his/her own assessment of the situation.
14. Lot Recombination Policy
In order for UPCA to recognize the combination of two adjacent lots, for dues purposes, the property owners must follow all Montgomery County policies concerning recombination.
15. Violation Enforcement Policy
A. NOTICE OF VIOLATION
Property owners will be notified by written notice that a violation of the Rights and Restrictions, Covenants, Articles of Incorporation, architectural guidelines, rules or resolutions has occurred. They will have 10 days from the date of the written notice to correct the violation, or communicate to the UPCA Office, an acceptable plan to correct the violation.
Property owners are responsible for the actions of their guests while they are in the community and will be notified of any violations by their guests. For repeated violations by owners’ guests, owners will be scheduled a hearing and fines may be levied as outlined below.
B. HEARING
If the violation is not corrected or the owner has not contacted the UPCA Office with an acceptable plan to correct the violation within 10 days of the date of the first notification, a second written notification sent via certified mail will be issued citing the violation, date of the violation, and the scheduled date of a hearing with the Violation Hearing Committee. The hearing will be held prior to the next regularly scheduled Board meeting. The owner will have an opportunity to set forth all facts to show compliance with the Rights and Restrictions, Covenants, Articles of Incorporation, architectural guidelines, rules or resolutions or a valid reason for an exception. The Violation Hearing Committee will deliberate outside the presence of the owner and render a decision. If the owner fails to attend the scheduled hearing, the fine will become effective immediately. The Committee will render a decision, including the fine if any.
The property owner will be notified of the Committee's decision by certified mail within five (5) business days of the hearing. The notification will include but is not limited to: the violation, Committee’s decision, amount of fine (if any), and date the fine will be imposed (if applicable). The fine will not begin until the hearing has been held and a decision has been rendered. Once the property owner receives the notification with the Committee's decision, the owner has the right to appeal to the full UPCA Board of Directors within five (5) business days from the date of the notification letter for an appeal hearing. The appeal hearing will be scheduled during the next regularly scheduled Board meeting. Once the appeal hearing has been held, the decision of the UPCA Board will be final.
C. FINE
The fine will begin on the 10th day following the date of the hearing. The owner will be notified of the amount of the fine via certified letter date and the fine will accrue at a maximum of $100 per day plus any legal costs incurred. The amount of the fine will be determined by the Board based on the severity of the violation and other factors as determined by the Board.
The fine will continue until the violation has been corrected. The owner has the responsibility for notifying the UPCA Office when a violation has been corrected. Once the UPCA Office has been notified, a compliance inspection will be conducted within 72 hours. If the violation is found to be corrected, the fine will cease effective the date the owner contacted the UPCA Office.
If the violation is corrected, and the Board is in agreement that the violation has been corrected before the fine begins, the property owner will not be liable to pay any fines but will be responsible for any legal costs incurred by the Association.
For violations that are intermittent due to their nature (i.e. speeding, Pet Policy, etc.) and are identified on two (2) separate instances within a 3-year period from the current violation, property owners will be subject to a minimum of a $25 fine per occurrence beginning with the second occurrence. Within a 3-yr period a progressive fine will be imposed at intervals of $25 per occurrence up to $100 per occurrence for each subsequent violation (i.e. $75, $100).
D. FURTHER ACTION
If the violation is not corrected and the fine has not been paid within 30 days from the commencement date of the fine, the Board may cause a lien to be placed on the property in the amount of the fine plus any legal and administrative costs incurred. If the violation is corrected after the fine begins, the property owner will be responsible for paying the amount of the fines up to the point that the violation is corrected, if the Board is in agreement that the violation has been corrected. If the fine is not paid within 7 days, after the correction of the violation, the fine will resume from the day it was originally imposed and will continue until all fines are paid in full, including all legal costs incurred by the Association.
E. RESPONSIBILITY
It is the property owner’s responsibility to notify the UPCA Office when a violation has been corrected.
F. ONSC MEMBERS AND GUESTS (non-UPCA members)
ONSC members, guests, vendors, etc. who are observed in violation of community policies will be sent a written notice of the violation and ONSC will receive a copy. ONSC members/guests who are cited a second time for the same violation within a 3-year period, will be issued a $50 fine with an option to schedule a Violation Hearing. In the event a fine is not paid within 30 days of issuance, the ONSC member/guest will be denied access within the community until the fine is paid.
16. Animal Control Reporting Procedures
Property owners who observe wildlife that is behaving in an odd manner should immediately contact Animal Control at 910-572-3067.
17. Property Maintenance Policy
All property within Uwharrie Point must be maintained in a state of good repair. “State of good repair”, as defined by the Uwharrie Point Community Association Board of Directors and the Uwharrie Point Architectural Review Board, in a policy adopted August 1, 2000, shall be defined as “a neat and maintained forest floor that provides a consistent streetscape throughout Uwharrie Point”. Any property that does not meet this criteria, will be considered in a “state of disrepair.”
The property shall be free of any downed, leaning, or broken trees or limbs (greater than 2” in diameter and/or 4’ in length); and uprooted stumps (root balls).
A property may also be judged to be in a “state of disrepair” by the Uwharrie Point Community Association Board of Directors and the Uwharrie Point Architectural Review Board if the property is deemed unsightly. Examples of an unsightly property may include but are not limited to excessive underbrush, tall grass, etc.
All properties shall be maintained as often as necessary to maintain the defined standards. If a property is determined to be in a “state of disrepair,” the property owner shall be notified in writing and given 30 days in which to bring the property into compliance with the standards set forth for Uwharrie Point. If the required maintenance is not performed within that time frame, UPCA may take action as provided for in the Declaration of Rights, Restrictions, Affirmative Obligations and Conditions Applicable To All Property In Uwharrie Point. The community association will obtain quotes for the work to be performed. The property owner will be notified by certified letter that the work will be contracted on their behalf 10 days following the date of the letter. The community association will contract for the lowest received quote. The work will be billed to the property owner along with an administrative fee for arranging and oversight of these services. The administrative fee will consist of 15% of the cost of cleanup or $100 whichever is lower. Failure to reimburse UPCA could result in late fee charges or a lien on the property.
18. Tree Removal
No trees measuring 6” or more in diameter at a point 2” above ground level may be removed without prior written approval by the company.
19. Collection Policy
The Board has directed the association’s attorney to act on its behalf on collection matters that have been referred to them by the Board or its Managing Agent;
All quarterly assessments are due on the first day of the first month of each quarter (Jan 1, Apr 1, Jul 1, Oct 1) and are considered delinquent on the first day of the second month of each quarter; and
The Managing Agent will send any homeowner who is ten (10) days delinquent, a late notice notifying them of the past due account and the late charge assessed. Prompt payment will be requested; and
Once an account has become thirty (30) days past due, the Managing Agent shall send a second notice to the owner requesting payment be made immediately to avoid further action; and
Once the account is more than forty-five (45) days delinquent, a third notice will be sent to the owner, via certified mail, indicating that the account will be turned over to an attorney for collection, if payment is not received within ten (10) days. The owner will be responsible for late charges, costs of collection and attorney’s fee; and
Once the account is turned over to an attorney, the attorney will send a demand letter requesting payment be made immediately, including all accrued late charges, costs of collection, and attorney’s fees. The demand letter will also state that the association intends on filing a lien on the property if payment is not made within ten (10) days; and
Any further action, including the filing of a lien, must be decided on by the Board prior to any action; and
The Managing Agent has the authority to approve a negotiated payment from a delinquent owner that is less than the total amount due, provided that the amount received is not less than the sum of the delinquent assessments and attorney fees; and
The association reserves the right to terminate use of the association property for delinquent accounts; and
Once an account has been turned over to an attorney for collection, any further communication with the owner shall be through the attorney. Any payments made shall be sent directly to the attorney until such time as the account has been brought current.
20. Changes to Exterior of Home or Landscaping
A request to the Architectural Review Board must be submitted prior to work commencing if you plan to make any exterior changes to your home or landscaping.
21. Compliance Inspection
After the completion of construction and/or landscape installation for new construction or additions/renovations, the homeowner is responsible for notifying the UPCA Office. Upon notification, a Compliance Inspection will be scheduled to review the home and/or landscaping. The inspection will include a complete review of the exterior of the home in comparison to the site plan, elevation drawings and materials submitted. The landscape inspection will include a review of the plant material in comparison to the plan submitted including but not limited to a review to ensure service areas, foundation, etc. meet screening requirements as stated in the architectural guidelines book. The ARB will review the inspection report for any non-compliant issues.
The homeowner will be notified via letter of any non-compliant issues that need to be addressed. Once the homeowner addresses the non-compliant issues a second inspection must be scheduled through the UPCA office.
When all construction and/or landscaping requirements have been met, the homeowner will be issued a refund of their initial compliance deposit.
Homeowners are ultimately responsible for all work occurring on their property and for ensuring that their homes and landscaping meet the requirements set forth in the current architectural guidelines. In the event, more than 1 compliance re-inspections are needed to review the completion of non-compliance issues, a $100 administrative fee will be applied for each compliance inspection over the initial 2 inspections. Non-payment of this fee will be deducted from the owner’s escrow deposit.
22. Contractor Guidelines
A. Construction, delivery and maintenance vehicles must use the construction gate entrance when entering the community.
B. Contractors must display a “yellow gate pass” in their vehicle at all times while in the community which is issued by security.
C. Construction employees may enter no earlier than 6:30 a.m. and may work no later than dusk.
D. No exterior work is allowed on Sunday.
E. All employees at your job site must obey all community rules, specifically the 25 m.p.h. speed limit within the community.
F. Fires are not allowed. Burning in barrels or any other devices is strictly prohibited.
G. All your employees, subcontractors, etc. should know the address of the jobsite and/or the owner’s name of the jobsite (i.e. “Jones” house on Stonebridge or “1429 Pennington Ferry”). Please be advised that if employees, subcontractors, etc. cannot provide the jobsite location to security, they will not be allowed to enter.
H. All employees at your job site must park on the job site or in the street. Parking on the road shoulders is not allowed.
I. Loud music on job-sites is not permitted.
J. All construction vehicles hauling debris must have a tailgate and be covered in order to prevent items from falling into the streets
K. Job sites should be monitored daily to insure that all litter, debris and paper is picked up.
L. Adjacent properties to your job site must remain in their original condition. You should not trespass, store materials, or cause any damage to an adjacent property (including UPCA property).
M. Silt fences must be maintained at all times to prevent drainage onto adjacent properties, streets, golf course and/or the lake.
N. Port-a-johns must be screened on 3 sides from view of adjacent homes, streets, golf course and/or the lake
O. All construction sites must have a dumpster or trash bin on the lot for disposal of all trash. The dumpster or trash bin must be in place by the time the foundation is dug.
P. Washing of any truck or vehicle on the street is not permitted. Any washing of concrete delivery trucks must be on the construction site.
Q. The contractor must clean up spills or leaks of any damaging materials (i.e. oil, gas, paint, etc.). (Please report spills or leaks to the UPCA Office as soon as possible.) Clean ups done by UPCA personnel will be charged to the responsible party.
R. Mud and gravel on the roadways should be minimized at all times. Contractor is responsible for removing mud and gravel on the roadways. Once it has been removed, contractor should contact the UPCA office in order to schedule the roadway to be washed.
S. Temporary job site office /storage trailers are permitted as long as they are located on the job site. The location for the trailer will be determined by the Association Manager prior to placement. Temporary hardscape or landscape screening may be required based on the visibility of the trailer from adjacent views
T. All materials delivered to the road shoulders must be moved on site within 24 hours. It is the responsibility of the property owner to insure that any damage to the road, curb, or shoulders of the road (UPCA property), be repaired.
U. It is understood that the ARB has the authority to bar or restrict any builder, contractor, subcontractor, etc. from entering Uwharrie Point if they are notified 3 or more times for a repeated violation of the architectural guidelines during the construction project.
23. Waste Disposal Facility Guidelines
Garbage disposal, recycling and yard debris disposal is available on-site for property owners in Uwharrie Point at the UPCA Waste Disposal Area. UPCA members should use their gate access card to open the gate into the facility.
A. This facility is for use by UPCA members and UPCA Authorized Persons ONLY.
B. The Association and contractors who work for the association occasionally store supplies and materials in the fenced-in waste area facility. The supplies and materials should not be removed from this area.
C. Help keep the facility as clean as possible. Do not leave trash or large items by the side of the dumpster. The waste disposal company is not responsible for removing items that are not placed inside the dumpsters.
Trash Compactor:
A. Owners should compact their own trash once it is placed in the compactor. The procedure is very safe and the unit will not function unless the door is completely closed.
B. Once trash is placed in the compactor and the door is closed, the owner will push a button on the control unit to begin compaction.
C. After the button is pushed, you are finished. Depending on the amount of trash in the compactor, it may be necessary to compact the trash more than once.
D. Only household waste is acceptable in the compactor. Mattresses, construction debris, metal, etc. is prohibited.
Recycling Container:
A. Items do not have to be sorted before placing in the Recycle container. However, please break down boxes before placing them in the dumpster.The recycling container is the firstcontainer once you enter the waste facility.
B. Items do not have to be sorted, however please make sure that only recyclable items are placed in the recycling container.
C. Please break down boxes before placing them in the dumpster. Unassembled boxes take up more space and cause the dumpster to be emptied more frequently.
Items accepted in the recycling container are as follows:
A. Glass: Beverage and food containers (green, brown, and clear) must be clean
B. Aluminum and steel cans should be rinsed out and labels removed
C. Plastic: (containers only - tops are considered trash and must be removed)
D. p.e.t.e. (mainly drink bottles), must be clean with tops removed
E. h.d.t.e.(mainly milk jugs), must be clean with tops removed; Clorox and dish detergent bottles, rinsed out with tops removed
F. Clean, unbound, loose newspapers
G. Corrugated cardboard should be broken down and no wax coated cardboard or moisture barriers are acceptable
H. Envelopes and magazines are acceptable.
Natural Waste Area:
A. Only biodegradable materials are allowed in the Natural Waste Area.
B. Natural waste should be placed behind the chained off area.
C. Leaves must be removed from plastic bags before placing in the disposal area. UPCA could be fined if items are dumped in this area that do not decompose.
D. Tree limbs must be cut into six-foot lengths or less.
IMPORTANT: If you hire a garbage contractor, tree service or landscape contractor the contractor must remove the waste they pick up or produce to an offsite disposal area. The UPCA waste disposal area cannot be used for this purpose. Please make sure contractors include offsite disposal in service contracts.
24. Regulation of Outdoor Fires Within the Community
Outdoor campfires, bonfires and other recreational fires are prohibited on any property encumbered by the Declaration of Covenants and Restrictions for Uwharrie Point. Outdoor fires will only be permitted within structured fire pits, approved by the Architectural Review Board. This policy is not intended to restrict or prohibit the use of gas or charcoal grills utilized for cooking purposes. Any person(s) found violating the policy will be subject to the enforcement procedures adopted by the UPCA Board of Directors.
25. Deer Feeding Within Community Prohibited
Supplemental feeding of deer on any property within Uwharrie Point is prohibited. This will include but is not limited to salt licks, corn, etc. Any person(s) found violating this policy will be subject to enforcement procedures adopted by the UPCA Board of Directors.
26. Flag Policy
General Purpose: The policy described below is designed to enable residents to express their patriotism to America in a manner that is sensitive to their neighbors and the overall appearance and continuity of the community. Additionally, this policy allows for the expression of individuality while upholding the standards of the community.
American Flags:
A. American flags no larger than 15 square feet (3’x5’) may be displayed on homes using standard flag mounting hardware.
B. American flags must be displayed in good condition and maintained to ensure that they are clean and neat in appearance.
C. UPCA reserves the right to require flags to be repaired, cleaned or replaced if not suitable for display.
Other Flags:
A. Although not encouraged, display of flags other than the American Flag within the community is allowed.
B. Decorative flags no larger than 15 square feet (3’x5’) may be displayed on homes to reflect special occasions or time of the season. Standard flag mounting hardware must be used.
C. Flags must be displayed in a manner sensitive to neighboring properties.
D. Decorative flags must be displayed in good condition and maintained to ensure that they are clean and neat in appearance.
E. UPCA reserves the right to require flags to be repaired, cleaned or replaced if not suitable for display.
F. Any flag deemed inappropriate by UPCA must be removed immediately upon notification.
Mailbox Flags:
A. An American flag no larger than 8” x 12” may be displayed above the mailbox on the front of the post above the mail box, or on the front of an approved 911 post using standard flag mounting hardware.
B. Only one (1) American flag per mailbox or post is permitted and the staff may not be longer than 12”.
Enforcement Procedure:
Any flag found to be in violation with the policy, may subject the owner to a fine or authorized removal of the non-compliant flag at the cost of the owner.
